The New Body

The profession of "abogado" in Spain is regulated by a Royal Decree of June 22, 2001 (Royal Decree Law No. 658/2001, entitled Estatuto General de la Abogacía Española). 

The Consejo General de la Abogacía Española is the body coordinating and representing the various Bar Associations existing in Spain.  The professional code of conduct (Código deontológico) applicable to lawyers who are registered with a Spanish Bar was approved on June 30, 2000 by the Consejo General de la Abogacía Española. This code, together with the royal decree regulating the profession are available at www.cgae.es.

Last will and testament

If you own property in Spain, we recommend that you have a Spanish will.

It is not mandatory to prepare a Will in Spain, but, the existence of a Spanish Will is a cost effective means of simplifying the handling of your affairs.

Lawer in Spain

Unfortunately if you dont have a Spanish will , no action can be taken in Spain until the probate of your English estate has been finalised. This can take a very long time – irrespective of whether your English Will or affairs are complicated or straightforward.  If you own property, yes. It is a slow and expensive process to get your foreign will recognized in Spain.

 

For your heirs to get your Spanish property transferred to their names, the process is much simpler if there's a Spanish will.

If there is no Spanish will registered at the Registro de Actos de Ultima Voluntad, then in the worst case, your property will pass to the local and regional government.

There is also the expense of preparing an official translation of the English Will and its legalisation to bear in mind, which together will cost significantly more than preparing a Spanish Will in the first place.
